These Terms & Conditions ("Terms") govern your use of the Election Management System ("the Platform", "we", "us"), operated by Logatta. The Platform is provided to electoral campaigns to manage voters, field teams, messaging, and election-day operations across web and mobile. By accessing or using the Platform you agree to these Terms. If you are using the Platform on behalf of a campaign or organization, you accept these Terms for that entity and warrant that you are authorised to do so.
1. Acceptance of these Terms
By creating an account, signing in, or otherwise using the Platform, through any of our websites, dashboards, or mobile apps, you confirm that you have read, understood, and agreed to these Terms and to the Privacy Policy. If you do not agree, you must not use the Platform.
2. Definitions
"Platform" means the Election Management System service in all its forms (web dashboards, public websites, and the iOS and Android apps). "Campaign" or "Event" means an instance of the Platform configured for a specific election, operated by a candidate, party, or political organization. "Account" means the credentials issued to an individual user of the Platform. "User" means any natural person who holds an Account, including campaign administrators, delegates, and voters. "Delegate" means a field-team member acting on behalf of a Campaign. "Voter" means a registered voter linked to a Campaign's voter list. "Content" means any data, text, images, files, or other material submitted to or generated through the Platform.
3. Account registration and responsibility
Accounts are created by a Campaign administrator via invitation. There is no public self-registration. You are responsible for keeping your credentials confidential and for all activity that occurs under your Account. Notify us at [email protected] as soon as you suspect unauthorised use. We may suspend or terminate Accounts that show signs of compromise, abuse, or violation of these Terms.
4. Permitted use
The Platform is provided to support lawful election operations: managing voter lists, coordinating delegates, communicating with voters that a Campaign has the right to contact, and producing election-day reports and analytics. You agree to use the Platform only for these legitimate purposes and in compliance with the election law of the jurisdiction in which the Campaign operates.
5. Prohibited use
You agree not to: (a) scrape, mass-download, or otherwise extract voter lists or other Content except through the export tools we provide; (b) use the Platform to intimidate, harass, threaten, or coerce voters; (c) attempt to gain unauthorised access to any part of the Platform, another Campaign's data, or another User's Account; (d) misrepresent your identity, role, or authority within a Campaign; (e) interfere with or disrupt the Platform's integrity or performance, including by uploading malicious code; (f) use the Platform in any manner that violates applicable election law, data-protection law, anti-spam law, or the rules of a relevant electoral commission; or (g) resell, sub-license, or commercially exploit the Platform without our written consent.
6. Campaign data and responsibility
Each Campaign is the data controller for the voter and delegate records it uploads to the Platform. By using the Platform, the Campaign warrants that it has the legal right under its jurisdiction's election law and data-protection law to collect, process, and contact the individuals whose data it uploads, and that it has provided the notices and obtained the consents required by that law. Logatta acts as the data processor on the Campaign's behalf. The Campaign is responsible for responding to data-subject requests from its voters and delegates in the first instance; we will assist as reasonably required.
7. Intellectual property
The Platform, including all software, designs, trademarks, and documentation, is owned by Logatta and its licensors and is protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose during the term of your Account. Campaigns retain ownership of the Content they upload; by uploading Content the Campaign grants us the licenses required to host, process, and display that Content within the Platform.
8. Service availability
We work to keep the Platform available on a best-effort basis but do not guarantee uninterrupted service for free or trial deployments. Paid deployments may have a specific service-level agreement set out in the order form for that Campaign. We may perform maintenance, updates, or changes that temporarily affect availability; where reasonably possible we will give notice in advance. Campaign services may stop automatically at the configured end date of an event.
9. Disclaimers and limitation of liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant the accuracy of the analytics interpretations the Platform produces, the conduct of any User, the outcome of any election, or the suitability of the Platform for any specific legal or political situation. To the maximum extent permitted by law, neither Logatta nor its affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform. Our total aggregate liability for any claim arising out of or relating to these Terms or the Platform is limited to the fees paid to us by the relevant Campaign in the 12 months preceding the event giving rise to the claim.
10. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your Account immediately for breach of these Terms, suspected fraud, or risk to the Platform or other Users. Upon termination, your right to access the Platform ends. The Campaign will have a 30-day window in which to export its Content; after this window we may delete or anonymize the Content in accordance with the retention schedule set out in the Privacy Policy. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
11. Governing law and disputes
Unless a Campaign's order form specifies otherwise, these Terms are governed by the laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai. Any dispute arising out of or in connection with these Terms will first be attempted to be resolved in good faith through direct negotiation. If the dispute cannot be resolved within 30 days, it will be finally settled by arbitration administered under the rules of the Dubai International Arbitration Centre (DIAC), seated in Dubai, in English. Nothing in this clause prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Platform, our service providers, or applicable law. When we make material changes we will update the "Last updated" date above and, where appropriate, notify Campaigns and Users in the app or by email. Continued use of the Platform after an update means you accept the revised Terms.
